What damages are claimable?

The following damages are claimable from the RAF:

• Past hospital, medical and related expenses;
• Future hospital, medical and related expenses;
• Past and future loss of income and/or income-earning capacity;
• General damages;
• Loss of support.

An analysis of personal circumstances in respect of each individual client is conducted so as to determine his or her specific needs. A top notch panel of medical and related experts is employed to ensure thorough and comprehensive report on these needs. The aim of the RAF is to place an accident victim financially and as far as possible, in the position that he/she was prior to the collision. As this is not always possible, payment is made by the RAF as a means of compensating an individual for his or her losses - both those losses which have already been incurred as well as those expected in the future.

The RAF provides cover for both past and future accident related, medical and related treatment. These costs are covered by way of an undertaking. An undertaking is a contract between the accident victim and the organization (RAF) in terms of which the RAF accepts liability to pay either 100% or a portion of a victim’s future medical and related expenses. Our experts provide extensive commentary on what medical and related treatment may be necessary for a victim to achieve a full, or alternatively, the best recovery possible from his or her injuries. This results in extensive cover under the RAF’s undertaking.

The entitlement of a victim to an award for general damages (pain and suffering, loss of the amenities of life, scarring and disfigurement and emotional shock and trauma) is governed by the Regulations of the RAF Act. The application of these regulations requires a thorough and in-depth investigation into the seriousness of the client’s injuries.
